These terms and conditions and the Distant Selling Regulations apply to all purchases of Goods and/or Services from KWIQ Supermarket Qatar through this Website. Please read these terms carefully before using this website. Using this website or placing an order indicates that you accept these terms.
1.1 When you purchase Goods and/or Services from this Website you agree to be bound by both these online terms and conditions and by the KWIQ Supermarket Direct website’s terms and conditions which govern your use of the KWIQ Supermarket Direct website,. Where there is inconsistency between the KWIQ Supermarket Direct website’s terms and conditions and the online terms and conditions of this Website, the online terms and conditions of this Website will prevail.
1.2 The online terms and conditions do not affect your statutory rights as a consumer.
1.3 The KWIQ Supermarket may vary the online terms and conditions at any time. Your continued use of the Website following any variation to the online terms and conditions shall be deemed to be acceptance of any variation.
1.4 If you do not accept these terms and conditions in full, you must leave this Website immediately. These terms and conditions shall apply every time your buy Goods or Services from the KWIQ Supermarket.
2 Service availability
2.1 The KWIQ Supermarket’s Website is for use by Qatar and overseas residents. However, Goods and/or Services marked as ‘residents only’ will only be supplied to residents living within KWIQ Supermarket.
2.2 Goods and/or Services ordered from the KWIQ Supermarket’s Website for delivery outside the Qatar may be subject to import duties and taxes or handling charges which are levied when the delivery reaches the country of destination. The KWIQ Supermarket does not have any control over these charges and cannot predict their amount. Payment of any such charges, taxes or import duties will be your responsibility and you must comply with the applicable laws and regulations held within the destination country. Please check with your local customs office for further information prior to placing your order.
3 The contract
3.1 Your order constitutes an offer to the KWIQ Supermarket to buy Goods and/or Services. All orders are subject to acceptance by the KWIQ Supermarket and such acceptance will be by way of email confirming payment has been received for the Goods and/or Services (the purchase confirmation). The contract between you and the KWIQ Supermarket will only be formed when you are sent the purchase confirmation.
3.2 The contract will relate only to those Goods and/or Services which have been confirmed in the purchase confirmation.
4.1 You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website may only open to you if you register. Access is given to this Website in accordance with these online terms.
4.2 You are asked to comply with the registration process located at the basket checkout. Each registration is for a single user only. The KWIQ Supermarket does not permit you to share your user name and password with any other person nor with multiple users on a network. Responsibly for the security of any passwords issued rests with you.
4.3 You warrant that in using the KWIQ Supermarket’s Website and completing the online registration you will not impersonate any other person, use a false name or, without proper authority act for any other person or organisation.
4.4 You are prohibited from posting or transmitting to or from this Website any material:
4.4.1 that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience;
4,4.2 for which you have not obtained all necessary licences and/or approvals;
4.4.3 which constitutes or encourages conduct that would be considered a criminal
offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the
rights of any third party, in the Qatar or any other country in the world; or which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).
4.5 You may not misuse the Website (including, without limitation, by hacking).
4.6 The KWIQ Supermarket will fully co-operate with any law enforcement authorities or court order requesting or directing the KWIQ Supermarket to disclose the identity or locate anyone posting any material in breach of paragraphs 4.4 and 4.5.
4.7 While the KWIQ Supermarket endeavors to ensure that this Website is normally available 24 hours a day, the KWIQ Supermarket will not be liable if for any reason this Website is unavailable at any time or for any period.
4.8 Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair beyond the KWIQ Supermarket’s control.
Whilst the KWIQ Supermarket makes every effort to maintain the accuracy of the information on this Website, it disclaims any warranty or representation, expressed or implied, about accuracy, completeness or appropriateness for a particular purpose.
6.1 The KWIQ Supermarket reserves the right to take legal action against committing or attempting to commit online fraud.
7 Price and payment
7.1 Prices and any additional related charges (where applicable) are as published on the KWIQ Supermarket’s Website for the relevant Goods and/or Services on the date of your order.
7.2 Where Value Added Tax (VAT) is chargeable, this will be added and displayed separately at the checkout, and on the order summary and receipt at the current prevailing rate. This rate may vary from time to time.
7.3 The KWIQ Supermarket’s Website contains a large number of Goods and/or Services and despite its best efforts there may be occasions where Goods and/or Services may be priced incorrectly. Where this has occurred, we are entitled to cancel your order and issue you with a refund for the amount you have paid, after which you can resubmit your order for the product at the correct price.
7.4 Meantime, payment for Goods and/or Services is accepted through major Cash on Delivery ( COD ) and in the future will be available by Bank Transfer or Credit and/or debit cards excluding American Express, Diners, JCB and other corporate business cards.Your card will be charged directly after your order has been placed but the time taken to process the payment through your account will be dependent on your card supplier.
7.5 The KWIQ Supermarket accepts no liability if a payment is refused or declined by the credit or debit card supplier for any reason.
7.6 The KWIQ Supermarket accepts no liability for any loss or damage, arising directly or indirectly,,as a result of a payment being refused or declined.
7.7 If you are purchasing from outside the Qatar you will be charged in your own currency and the banks will perform the currency conversion into pounds sterling.
7.8 Confirmation of your payment will be displayed on screen once it has been authorized and accepted. You will also receive confirmation of the transaction to the email addressyou have provided.
7.9 We reserve the right to refuse to process payments.
7.10 We may at our sole discretion do such checks as we may deem fit before processing a credit or debit card payment from the user, for security reasons. As part of such checks, we may disclose personal data to third parties for the purpose of carrying out these security checks. In the event that we are not satisfied with the credibility of the User, we will have the right to reject the payment.
7.11 We will not be liable for any damages resulting from our decision not to process a
payment made through our Online Payments facility.
8.1 The KWIQ Supermarket will deliver the Goods to the Delivery Address you gave when you placed the order.
8.2 Your order will be fulfilled within 2 days of the date of purchase unless we specified otherwise in the terms and conditions for individual Goods and/or Services.
8.3 The risk in the Goods will pass to you as soon as they are delivered to you.
9 Refunds and cancellations
9.1 Where you are entitled to a refund it will be made to the credit or debit card used to pay for the order within 30 days of the date the refund was requested.
9.2 If for any reason the KWIQ Supermarket is unable to supply the Goods and/or Services you have ordered any charges incurred will be refunded.
9.3 If the Goods and/or Services are not what you originally ordered or are damaged or defective, the KWIQ Supermarket will either (at your request) refund you the amount you paid for the products (including any postage and packing charges), or replace the products you received with products which conform to those ordered. You will need to return the original item before a refund can be issued or a replacement sent. We will also refund the cost of return postage provided you supply a receipt.
9.4 You have the right to cancel the contract and return Goods and/or Services up to fourteen working days following delivery. The KWIQ Supermarket will refund the cost of the Goods and/or Services returned but it is not obliged to refund the cost of postage and packing. Any refund will be made within 14 days of receipt of the Goods and/or Services provided that the Goods and/or Services are in the same conditions as they were at the time of purchase.
9.5 You do not have the right to cancel the contract once the performance of any Services has commenced with your agreement prior to the end of the cancellation period.
9.6 you must take reasonable care of the products while they are in your possession, and ensure that they are returned in the same condition as when they were received by you.
10 Data protection policy
10.1 The KWIQ Supermarket does not hold customer credit or debit card details on its Website or any of its data systems. All credit or debit card details are managed by the KWIQ Supermarket’s payment service provider Netbanx, who is compliant with the payment industry’s highest standards for data protection and transaction security.
10.2 Any personal data collated through the KWIQ Supermarket’s Website will be treated confidentially, and will only be used to process your order and for statistical analysis to continually improve the Website and its Services to you, and to service the Website. Personal data will be processed in compliance with the principles of the Data Protection Act 1998.
10.3 Data may be shared with the police, the government or any other legal authority investigating suspected legal activities if there is an official request.
11.1 As a customer you agree to indemnify the KWIQ Supermarket against all claims, damages and expenses arising out of any breach of these online terms and conditions and other liabilities arising out of your use of the KWIQ Supermarket’s Website.
12 The entire agreement
12.1 These online terms and conditions and any document expressly referred to in them, represent the entire agreement between you and the KWIQ Supermarket in relation to the subject
matter of any contract. These online terms and conditions supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
13 Limitation of liability
13.1 The KWIQ Supermarket will not be liable in contract, tort, or pre-contract representations (excluding fraudulent or negligent misrepresentations) or otherwise, for any economic losses, loss of goodwill or reputation, or special indirect losses incurred by you or any third party arising out of or in connection with these online terms and conditions.
13.2 These online terms and conditions do not exclude or limit the KWIQ Supermarket’s liability for death or personal injury arising through its negligence.
13.3 The KWIQ Supermarket will not be held responsible for any delay or failure to comply with its obligations under these online terms and conditions if the delay or failure arises from any cause which is beyond its reasonable control.
14.1 These online terms and conditions shall be governed by and construed in accordance with the laws of Qatar and any disputes will be decided by the Courts of Qatar.
15 Complaints and disputes
15.1 If there is an occasion where an issue has not been resolved to your satisfaction you
may wish to contact Customer Services regarding your complaint.
15.2 Complaints will be dealt with in adherence to the KWIQ Supermarket’s complaints policy.
